Associate Terms & Agreements for GSD
Numbers 1,2,3,8,9,11 & 13 have been revised by the GSD admin dated (03/07/2010).
Also #s 22 & 23 have been added.
1. I am of legal age in the state in which I reside and enter into this Agreement.
I will not knowingly bring in any other "underaged" members.
2. This Agreement becomes effective upon acceptance of these
Terms and dated Application & Agreement. (the day I joined)
3. Upon acceptance, I will be an Independent Associate (IA) of GSD.
(I enter into this agreement by choice)
4. I agree that as an (IA) of GSD, I am not an agent, employee,
franchisee, or legal representative of the Association, and I will not
be treated as an employee for any federal or state purposes, nor for purposes of the Federal Employment Act, the Federal Insurance Contributions Act, the Social Security Act, State Employee Acts, State Employee Security Acts, State Unemployment Acts, or State Workers Compensation Acts, nor any and all such Acts relative to Employee/Employer relationships, since no such relationship
exists herein.
5. I agree that I am solely responsible for payment of all Federal, State, Municipal, and any and all other income taxes, self employment taxes, sales taxes, license fees, etc., that may be incurred or come due as a result of my Association activities, not of GSD.
6. I warrant that I am in compliance with all applicable laws, rules, regulations and ordinances of my Town, City, Municipality, County, Parish, State, etc., in connection with my Association activities. This is not GSD responsibility to verify that this information is true and/or accurate.
7. I understand that there is no purchase required in order to be able to sell the Association's services as an (IA). (due to the unique PIB method, others could
have purchased product in my behalf, in order to help me get started).
8. I understand that as an (IA), I am not guaranteed any income, profit,
or level of success, other than earnings from my own sales of the Association's services as outlined in the Association's compensation program and that I am responsible for my own (IA) expenses.
There are 5 ways to get paid in the "Cyclers" if you bring other people in, there is
only 1 way to get paid (# 5) if you do not bring other people in.
The 5 ways to get paid explained below:
- #1 ... Sponsor Bonus ... (when you bring people in)
- #2 ... Cycle Bonus ... (when your members cycle)
- #3 ... Re-purchase Bonus ... (when they re-purchase)
- #4 ... Re-entry Bonus ... (when the system gives them extra BCS)
- #5 ... Your own progression through the system.
9. I agree that I will represent the Association's business opportunity honestly and completely emphasizing that commissions are earned from sales of the Association's services. I will make no representations concerning earnings
real or potential, and that I will inform prospects that no purchase is necessary in order to profit from direct sales as an independent contractor as outlined in item number seven above. If I violate this agreement, I will be dismissed from GSD with no further attachements and or earnings.
10. I agree that in order to maintain a viable compensation program in today's competitive worldwide marketplace, and in order to comply with changing Federal, State, and Local laws, the Association may find it necessary to enhance its Associate Terms & Agreements and/or its compensation programs and such modifications shall become part of the Agreement. I also agree that the administation can modify these Terms and or Agreements at any time to suit the needs and protect the members, programs and/or administration of GSD.
11. I agree that I am responsible for supervising and supporting GSD (IA) sponsor into the Association. The admin is not responsible to build my business.
The admin will provide Training and Instructions. It is up to the members to make
themselves available to/for ALL and any of these said presentations.
12. I authorize the Association to publish my name or image for achievement recognition.
13. I agree not to use the Association's name, logo, trademark, etc. without prior written approval from the GSD administration. ( you may use anything from our
sites to promote your account business with us) Just contact admin before doing so.
14. I agree that due to the unique Design aspects of the Association's compensation program, I will forward all Applications in my possession, along with funds pertaining thereto, to the Association within 24 hours of my receipt of same.
15. I agree that the Associate Terms & Conditions, in combination with
the Application & Agreement and the Association's marketing materials, which may be enhanced from time to time, constitute the entire Agreement and that if any part of said Agreement shall be deemed null and void, other parts shall remain in effect. Latest dated revisions shall apply.
16. I understand and agree that I may cancel my GSD membership in the Association at any time and that the Association may cancel my membership if at any time I am found to be in violation of normal and reasonable ethical business practices while representing GSD.
17. I understand that there are No refunds at GSD since commissions to other
members would have already been paid out.
18. I understand that before I agreed to ALL of these said Terms and
or Agreements, I was given FULL opportunity to read them ALL before Joining GSD and by joining GSD this states that I have read them ALL
and I Agree to them ALL.
19. I understand and agree that GSD is a safe environment Association
and the GSD administration will not tolerate threats of any sort to its members and especially to its administration. If I am found violating this agreement I will be dismissed with no further attachments (Including all earnings) from GSD. This also extends to speaking negative comments about GSD in any way, shape and/or form. This include disrupting any conference calls.
20. I understand and agree that it is my responsibility to not only follow these terms and agreements, but it also extends to learn about the benefits of a full membership with GSD. I agree that I will do my part to learn all there is to learn about GSD. It is the members resposibility to promote and build their individual business down-lines, not the GSD admins.
21. I have been given the opportunity to read all of these Terms and or Agreements of GSD and I do agree to all of them.
22. Independent Teams within GSX:
Whereas we think that members within GSX who choose to build their own organization could be a positive force for our members, if properly structured,
we neither encourage or discourage your participation in these organizations,
Further, GSX admin cannot be responsible for the terms and conditions of any independent group within our group of programs. We are only responsible for
GSX terms and conditions that are spelled out, in detail, on our GSX site.
23. Business Management Plan Explained:
This applies to both our Cycler & Residual Programs.
When you have earned $50 to $1200 > (50/50 split)
50% to earnings account and 50% business account.
When you have earned $1201 to $2200 > (60/40 split)
60% to earnings account and 40% to business account.
When you have earned $2201 to $4200 > (70/30 split)
70% to earnings account and 30% to business account.
When you have earned $4201 to Infinity > (80/20 split)
80% to earnings account and 20% to business account.
Funds in your Business Account can be used for the following:
* To purchase more BCs in Cyclers for you or other members (PIB).
* To purchase more Positions in the Residuals for you or other members (PIF).
* To support any of the Charities that we have in our portfolio.
